I agree totally with Jen. H.R.4239 could put you into jail longer then if you committed a criminal act. I dis agree with those who say peaceful demonstration or even helping an abused animal would be illegal. Some big businesses who are doing these abuses are the ones who fear being exposed to the public and getting into trouble with the law for they KNOW they are the ones doing the wrong things. Our government is putting a muzzle on it's own citizens and that should make ALL OF US stop this. What is happeneing to America, the land of thr free? Since when is a person a "Terroist" if they disagree in public or help someone who is being abused criminal? I thought the Iron Wall went down in Germany (where I was born, by the way). It is being slowly erected here in the US - how can that be not seen, or accepted with so little emotion. I am outraged!!!! Aren't YOU!!!!!!!!!!!!!!!!!!!!!!!!!!!!

ok , so does someone passing this bill own some stock in one these places to want to protect them or what? That's crap!!! What ever happened to freedom of speech? You can't take the animals away from these people all you can do is speak your mind and hope people will listen and stop supporting them so they go out of business!!! Now you can't do that either! What are you able to do? Just watch and pray? Sorry but that really doesn't help much for the animals that are suffering in there. What is this world coming to? If they weren't doing anything wrong they wouldn't need to worry about it!!! Talk about a guilty conscience, is it trying to tell you something? The inconsiderate, selfish, greedy JERKS!!!

Contrary to the false assertions in this article, the language in the Animal Enterprise Terrorism Act (S. 3880), which passed in the Senate on September 29th, makes specific provisions for protection of First Amendment rights. The bill seeks to allow the Department of Justice to pursue cases on extremists who commit acts of terror against animal enterprise organizations.

The specific section within the bill ensuring First Amendment rights states:

"Nothing in this section shall be construed to prohibit any expressive conduct (including peaceful picketing or other peaceful demonstration) protected from legal prohibition by the First Amendment to the Constitution; to create new remedies for interference with activities protected by the free speech or free exercise clauses of the First Amendment to the Constitution, regardless of the point of view expressed, or to limit any existing legal remedies for such interference; or to provide exclusive criminal penalties or civil remedies with respect to the conduct prohibited by this action, or to preempt State or local laws that may provide such penalties or remedies."

The bill would allow prosecution of individuals who harass or harm people engaged in animal enterprise. It goes on to specify punishment depending on the severity of damage, which includes bodily injury and economic damage.

The bill’s language can be read here:

Bottom line is that it's geared to protect those who are harming animals and against those that are opposed to the senseless abuse.
I'm all for being a voice for the those that can not speak. The animals are innocent in this and the corporations that gain from their suffering need to be exposed, even if means losing profits.
Only the greedy abusers will gain from this bill being passed, if they weren't doing anything wrong (even if it's legal) they wouldn't stand to lose money by being protested against.
If they have to the right to harm animals, we should certainly have the right to speak out against it.

The new AETA does NOT make peaceful protest a crime. ASPCA would love everyone to think it does. It specifically states that peaceful protest is in fact still VERY legal.
